GENERAL TERMS AND CONDITIONS
These General Terms and Conditions apply to all deliveries from AZEZANA to consumers (§ 13 of the German Civil Code - BGB). A “consumer” is defined as any natural person who concludes a legal transaction for a purpose, which can be assigned to neither his commercial nor his freelance professional activities.

3. Offer and conclusion of the contract
3.1 The presentation of the products in the online shop does not represent a binding offer, merely an invitation to place an order. Errors excepted.
3.2 By clicking on the Order button in the last stage of the ordering process you are submitting a binding order for the goods listed on the order page. The purchase contract comes into force with our acceptance of your order in the form of an order confirmation e-mail sent to you directly after receipt by us of your order.
4. Right of revocation
Consumers have a thirty-day right of revocation.

You may within 30 days and without any requirement to state reasons revoke your contractual statement in text form (e.g. by letter, fax, e-mail) or - if the merchandise has been supplied prior to the expiry of the period of notice - by returning the merchandise. The period of notice begins after receipt of this instruction in written form, not however before the recipient has received the goods (in the case of repeat deliveries of identical goods, not before receipt of the first part delivery) and also not before our duties of information pursuant to Article 246 § 2, in combination with § 1 (1) and (2) EGBGB (Act introducing the German Civil Code) and our obligations pursuant to § 312e (1) (1) BGB, in combination with Article 246 § 3 EGBGB, have been fulfilled. The period of notice of withdrawal will be deemed to have been adhered to as long as the notice of withdrawal or the merchandise in question have been dispatched within said period. Consequences of revocation
In the event of effective revocation, the services received by either party will be returned and any benefits that may have been accrued released. If you are unable to return the rendered service either in full or in part or only in deteriorated condition, you may be liable to pay compensation in this respect. In the case of goods surrendered this does not apply if the deterioration of the goods is attributable solely to the testing thereof, such as would have been possible for you, for example, in a retail outlet. For the rest, you can avoid any duty to provide compensation for any deterioration of the goods caused by the intended use thereof by not using the merchandise as if it were your own property and refraining from all actions that may affect its value. Merchandise capable of dispatch by post is to be returned to us at our own risk. The costs of returning orders from locations within Germany will be assumed by AZEZANA. In the case of the return of goods from abroad, the return shipment costs are to be borne by the customer. Any obligations to refund payments must be fulfilled within 30 days. The period of notice begins for you with the dispatch of your notice of revocation or of the merchandise, for us with the receipt thereof. End of the instruction on revocation.
5. Prices and dispatch costs
5.1 All prices are quoted inclusive of sales tax at the statutory rate in force in Germany at the time of ordering.
5.2 The prices relate to the article pictured in each case as described, but not to content, accessories and decoration.
5.3 Deliveries to countries outside the EU may incur additional customs duties or other charges: these vary from country to country and must be paid by the purchaser at the point of delivery. For more information on the amount of any charges that may be incurred, please consult your local customs authority.

6.1 Delivery within Germany will be carried out using Deutsche Post to the delivery address stated by you.
6.2 Delivery will take up to 5 days. Any deviations from this standard delivery time are indicated on the product pages in question. We make every effort to ensure that delivery schedules are adhered to. In the event of delays attributable to circumstances unknown to us at the time the order was placed and for which we are not responsible, delivery times will be extended commensurately; we will inform you immediately of any such delays.
6.3 Should we no longer be able to supply a particular article, we will be entitled to release ourselves from the contractual obligation to make the delivery. In such a case, we will inform you immediately of the non-availability and, if already paid, refund the purchase price without delay.
7.1 You can choose between the following payment methods: bank transfer, cash, Paypal or Paypal Express.
7.2 You will be entitled to offset only if your counter-claims have been recognized by a court of law as legally valid, are uncontested or have been recognized by us in writing.
7.3 You may assert a right of retention only inasmuch as the claims arise out of the same contractual relationship.
8. Retention of title
8.1 Until such time as full payment of the purchase price due to AZEZANA has been made, the goods will remain the property of AZEZANA. If the customer is a trades person as defined in the HGB, AZEZANA will retain the title to all goods delivered until the point of receipt of all payments arising out of the business transaction.
8.2 The customer undertakes to treat the goods with all due care until the point of transfer of title.
9.1 Data, drawings, images, technical specifications and descriptions of weight, dimension and performance contained in brochures, catalogs, circular letters, advertisements or price lists serve the purpose of information only. AZEZANA assumes no liability for the correctness of such information. In respect of the type and scope of the delivery, the information contained in the order confirmation alone is authoritative.
9.2 Should a defect be present which falls within the scope of the warranty, you are entitled by law to require remediation, to withdraw from the contract or to reduce the purchase price.
9.3 In the event of a return of goods due to defects, AZEZANA will assume the shipment costs.
9.4 Warranty claims on the goods delivered will expire two years after receipt thereof. If the ordering party is an enterprise, the period of limitation for warranty claims is 1 year.
10. Applicable law and legal venue
This contract is subject exclusively to German law (to the exclusion of any references to other legal systems and the UN Convention on Contracts on the International Sale of Goods – CISG). For contracts with tradespeople, legal persons under public law or special funds governed by public law, and with persons with no general legal venue within the European Economic Area, the legal venue and place of fulfillment is Frankfurt.

If you have set up a customer account, you can review your customer data at any time under 'Customer log-in'. The order information and General Terms and Conditions will be sent to you by e-mail. After the conclusion of the ordering process, the text of the contract will for security reasons no longer be accessible via the Internet.
